Terms And Conditions
These terms and conditions have been composed to be inline with the current Consumer Contract Regulations 2013
Placing an order– Placing an order with Leaf & Lake Co. is primarily done via the website www.LeafandLakeCo.Com. However, orders may be taken via social media platforms however the collection of payment will always be done by a secure method such as bank transfer. Upon placing an order with Leaf & Lake Co. you agree to all terms & conditions set out here and confirm that you have entered into a sales contract. It is my responsibility to supply you with goods that meet your consumer rights. If you have any concerns that I have not met your legal obligation then please contact me.
Custom Orders– If you wish to place a custom order (ie- wedding favours) with Leaf & Lake Co. then there are additional terms & conditions which apply and slightly affect your consumer rights. For all custom orders a non-refundable deposit of 50% of the total cost is to be paid up front. You will be contacted prior to work commencing on your custom item/s for final confirmation for me to start the making process. The regulation advises that consumers who place custom orders lose their right to cancel (see cancelling orders for more information) and full payment of the order is still required. However, here at Leaf & Lake Co. if work has NOT commenced on your items and you wish to cancel then I will NOT collect the full amount owed. Any paid prior amounts (deposits etc) will be retained by Leaf & Lake Co.. In the event that work has started on your item, after you have given final confirmation to go ahead and create your items then FULL payment will be required. If full payment of your custom item is NOT made then legal proceedings may be induced to obtain any outstanding amounts owed.
Reserving Items– A reservation service is offered here at Leaf & Lake Co. However, there is a 48 hour holding period in which payment should be made. If no payment has been made by the end of this time then the reserved item/s will go back on sale for the general public to purchase. Shipping– As a UK based business I ship within the UK only. All p&p options are given during checkout and include packaging fees.
Order Dispatch– Once your order is complete (I aim for approx 4 working days) and ready for shipping I aim to post as soon as possible for me to do so. I am often only able to post once a week and the day varies. However, If I am able to post more regular then I do so. The consumer contract gives me 30 days allowable time for your order to be posted. This, I hope, will never be the case here.
Delivery, P&P, Risk– Here at Leaf & Lake Co. I primarily use royal mail. In ALL instances your order will be sent tracked/recorded. Alongside the postage prices there is an additional fee (between 1p-20p) added on to cover packaging costs. Until the item reaches you chosen shipping address the responsibility lies with me/the postal service. Once the order is in your possession the responsibility lies with you for the duration of the ‘cooling off’ period and returns (If applicable). If you wish to use a postal service other than those which I use then please contact me before making a purchase. Please note that should you want to use a different postal service then the responsibility is lifted from me.
Additional Fees– As mentioned above in the ‘delivery, p&p, risk’ section there are additional fees which sometimes occur. In rare instances whereby your order exceeds the weight of the postage options provided on the website then I will be intouch to discuss collection the additional costs to cover postage. This may result in an additional fee (if collected via paypal, as paypal charges fees per transaction)
Returns– Returns are accepted here at Leaf & Lake Co. You have 14 days from the date after you receive your goods to return them. This is called the ‘cooling off’ period. If within 14 days you decide you wish to return your item then you must get intouch to advise me of your want to return. Returned items must be in their original condition. You as the consumer have a statutory right to take reasonable care of the goods whilst in your possession during the 'cooling off’ period. Any returns deemed not in their original condition or signs of unreasonable care is present then a right of action may be taken against you. All returns postage costs are to be paid by you and will not be refunded by Leaf & Lake Co. You are responsible for the goods until they are back in my possession. If you fail to return the item then you may be liable for alternative collection fees. Returns should be sent to Leaf & Lake Co, 24 Grisedale Place, Cockermouth, Cumbria, CA13 9JE. It is advisable for you to obtain proof of postage upon returning your item.
Unclaimed/Returned items- Any parcels which are returned back to me due to reasons such as it not being picked up from the sorting office should a delivery attempt have been tried and failed or other similar reasons (Addressee not known etc) will not be eligible for a refund of the order IF the 14 days timescale from the delivery attempt date has passed. Furthermore, any refunds which are issued will be minus the original p&p fees paid.
Cancellations– If you wish to cancel your order then you can do so, but this has to be done within 14 days. If you have already received your items then you have 14 days from the day after you received your item in which to cancel and return. See above information on details on how to return your items to Leaf & Lake Co. Please note that if your order is a custom order then you lose your right to cancel. Refund amounts may be reduced for any returned items which show evidence of use beyond the handling to see whether the goods are as expected. Any refunds will be inclusive of outbound p&p costs unless unclaimed parcel (see above).
